Terms and Conditions

These Terms govern your use of Chithandizo.com. Please read them carefully, together with our Privacy Policy, Refund Policy and Pricing page, which form part of these Terms.

1. About us

Chithandizo.com (“Chithandizo”, “we”, “us”) is a fundraising platform operated by InteGrow Capital Group, a for-profit company registered and operating under Malawian law, based in Lilongwe, Malawi.

2. Accepting these Terms

By using Chithandizo, creating an account, starting a campaign or making a donation, you agree to these Terms. If you do not agree, please do not use the platform.

You must be at least 18 years old, or have the consent of a parent or guardian, and be legally able to enter into this agreement. If you act for an organization, you confirm that you have authority to bind it to these Terms.

3. Our role

Chithandizo provides the technology that lets fundraisers (“Fundraisers”) raise money from donors (“Donors”). We are not a charity, and unless we state otherwise, we are not the organizer of any campaign and we are not a party to the arrangement between a Fundraiser and a Donor.

We review new campaigns before they go live, but this review does not confirm that every statement in a campaign is accurate. We do not guarantee that a campaign will reach its goal, or how a Fundraiser will use the funds raised.

4. Accounts

  • You must provide accurate information and keep it up to date.
  • You are responsible for keeping your login details secure and for activity on your account. Tell us promptly if you suspect unauthorized use.
  • Fundraisers must verify their email address, and their accounts must be approved by us, before they can log in and use fundraising features.
  • We may ask for further information to confirm your identity, your campaign or the intended use of funds.

5. Fundraiser responsibilities

If you run a campaign, you agree to:

  • provide truthful, complete and non-misleading information about the campaign, its purpose and its beneficiary;
  • use funds only for the purpose described in the campaign, and tell Donors promptly about any material change;
  • obtain the consent of any person whose story, name or image you share, or of their parent or guardian where appropriate;
  • hold any licence, permission or registration that your fundraising requires;
  • keep records of how funds are used and provide them to us if we ask; and
  • meet all legal obligations that apply to the funds you receive, including any tax obligations.

6. Prohibited campaigns and conduct

You may raise money for any lawful cause. You must not use Chithandizo for anything that is, or that supports:

  • fraud, deception, impersonation or misleading claims;
  • money laundering, terrorist financing or any other unlawful activity;
  • violence, hatred, harassment or discrimination;
  • the exploitation or abuse of any person, especially children;
  • illegal drugs, weapons, gambling or sexually explicit material;
  • material that infringes the rights of others, including their privacy or intellectual property; or
  • spam, malware, automated account creation or interference with the platform.

7. Donations

  • Donations are voluntary gifts. A donation does not buy goods, services, ownership or any other right, unless a campaign clearly states otherwise.
  • You are responsible for deciding whether to support a campaign. Please review it carefully before you donate.
  • Donations are processed through our payment partners, including PayChangu. Card issuers may separately charge you international or foreign exchange fees. Those are not charged by Chithandizo.
  • We do not promise that a donation is tax deductible. Please seek your own advice on any tax treatment.

8. Fees

Creating and managing a fundraiser is free. A transaction fee of 10% is deducted from each donation. It covers mobile money charges, PayChangu gateway fees and the cost of running the platform, and it is the only fee Chithandizo deducts from donations. We may change our fees by updating our Pricing page. A change will not apply to donations made before it takes effect.

9. Withdrawals

Once your available balance reaches MK20,000, you may request a withdrawal to your wallet or bank account. Payouts take no more than 2 days, unless a request needs further review. We may delay, limit or withhold a payout where we reasonably need to investigate suspected fraud, a dispute, a breach of these Terms or a legal requirement. You are responsible for giving us correct payout details.

10. Refunds

Donations are generally final and non-refundable. Refunds may be available in exceptional circumstances, such as fraudulent or unauthorized transactions, accidental duplicate donations or platform errors, if you contact us within 14 days of the donation. Once funds have been withdrawn by a Fundraiser, we may be unable to issue a refund. Our Refund Policy sets out the details.

11. Chargebacks and reversals

If a donation is reversed, refunded or charged back, we may deduct the amount and any related cost from the Fundraiser’s balance or from future payouts. If the balance is not enough, the Fundraiser agrees to repay the amount to us on request.

12. Your content

You keep ownership of the content you submit, including text, photos and videos. You give us a non-exclusive, royalty-free, worldwide licence to host, display, reproduce and share that content in order to operate and promote Chithandizo and your campaign. You confirm that you have the rights to grant this licence. We may remove content that breaches these Terms.

13. Our intellectual property

The Chithandizo name, logo, website design and software belong to us or our licensors. You may share links to campaigns, but you may not copy or use our branding or software in any other way without our written permission.

14. Privacy

Our Privacy Policy explains how we collect and use personal information. Please note that, depending on campaign settings, a Donor’s name and donation amount may be shown publicly unless the Donor chooses to give anonymously.

15. Suspension and removal

We may reject or remove a campaign, restrict features, or suspend or close an account if we reasonably believe there has been a breach of these Terms, a risk to Donors or others, or a legal requirement. Where appropriate, we may hold funds or return them to Donors. You may stop using Chithandizo at any time by contacting us, but these Terms continue to apply to earlier activity.

16. Third-party services

Chithandizo relies on third parties, including payment providers, mobile money networks and banks. We are not responsible for their services, and their own terms may apply to you.

17. Disclaimers

To the extent permitted by law, Chithandizo is provided “as is” and “as available”. We do not guarantee that the platform will be uninterrupted or error free, or that any content posted by users is accurate.

18. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from the acts or omissions of Fundraisers, Donors or third parties. Our total liability for any claim relating to the platform is limited to the fees we received in connection with the transaction giving rise to that claim. Nothing in these Terms limits any liability that cannot be limited by law.

19. Indemnity

You agree to compensate us for reasonable losses, claims and costs that result from your breach of these Terms, your campaign or your misuse of the platform.

20. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and change the date above. If you continue to use Chithandizo after a change takes effect, you accept the updated Terms.

21. Governing law

These Terms are governed by the laws of Malawi. We will try to resolve any dispute informally first. If that is not possible, the dispute will be decided by the courts of Malawi.
